On January 2, 2013, the Honorable Zack Hawthorne, United States Magistrate, Eastern District of Texas, entered an order denying Union Pacific Railroad Company’s to sever the claims of four former employees who had filed suit alleging personal injuries resulting from their exposure to asbestos while employed by Union Pacific. Union Pacific sought to sever the claims into separate lawsuits, or that in the alternative, that the Plaintiffs’ claims be tried separately. The court found that “trying the Plaintiff’s claims in a single trial would further the interests of avoiding delay and ensuring judicial economy.” A copy of the Court’s order is available.
